| ABSTRACT |
| This book is about prosecution of youth in criminal (adult) courts and juvenile courts, respectively. It is based on research carried out in the states of New Jersey and New York, which have very different policies with regard to whether youth are judged in criminal or juvenile courts. The book argues against the policy of transferring large numbers of youth to criminal courts, maintaining that it is inconsistent with cultural understandings of youth. The author examines the prosecution of adolescents in criminal and juvenile courts, respectively, and argues that while they are treated differently during the initial stages in criminal courts and generally receive harsher punishments there, criminal courts introduce elements of juvenile justice during the sentencing process, something which the author sees as a result of cultural perceptions of youth. |
